Terms of service
A draft of the commercial relationship: the free trial, the monthly membership, and the placement fee. A lawyer needs to turn this into the agreement you actually use.
The service
ApplyOnBehalf is a career-placement and consulting firm. Automation finds roles and moves applications. Career specialists review, tailor, and manage the search. The public offer is 100+ tailored applications per week for the client’s target role, LinkedIn optimization and management, background-check preparation support, recruiter replies, a dashboard of actual applications, application email to the client’s inbox, a weekly report, and a weekly call.
The client’s part is to provide an accurate profile, pick up calls, and give interview times.
14-day free trial
The trial is 14 days at no membership charge. [LEGAL REVIEW] State whether a payment method is collected at the start, the hour the trial ends, what happens if the client does nothing at the end, and how to stop during the trial so the $99 membership does not begin.
Membership
If the client continues, membership starts at $99 per month. That price is the live offer on this website and is configured in content/pricing.ts.
[LEGAL REVIEW] State the billing date, taxes, failed payments, and how either side ends the monthly membership. Do not treat this paragraph as a cancellation policy.
Placement fee
As a staffing firm, ApplyOnBehalf charges a one-time placement fee of 10% of first-year salary if the client is placed. The fee is separate from the monthly membership.
[LEGAL REVIEW — required before this is a contract] Define “placed” (offer signed, start date, or something else). Define “first-year salary” (base only, or bonus, equity, and contract length). State when the fee is invoiced, who pays it, what happens if the client leaves the job quickly, what happens if the client accepts a role the firm did not submit, and what happens if the client was already in process with that employer. Until a lawyer writes those definitions, the 10% figure is the commercial intent, not final legal language.
We work until you are placed
“We work until you’re placed” is how the service is run: the team keeps applying while the membership is active. It is not an unconditional guarantee of a job, a salary, an interview, or a date.
[LEGAL REVIEW] Write the real commitment: how long the firm continues, what the client must keep doing, and what ends the obligation. Do not publish an absolute guarantee.
Truthful materials
Resumes are tailored from the client’s real history. ApplyOnBehalf does not add employers, titles, degrees, or skills the client did not earn. The client is responsible for the accuracy of what they provide.
Liability
[LEGAL REVIEW] Add any limitation of liability, disclaimer of warranties, and governing law (the office address is in California). This draft includes none of those clauses on purpose.
